Barton to face second degree murder charge, distribution charge
Sunday, February 10, 2008
Mitchell Barton has been bound over to the circuit court for a murder charge filed in Iron County.
According to a press release from Iron County officials, Iron County Associate Circuit Court Judge Randall Head heard a preliminary hearing on Thursday concerning charges of second-degree murder and distribution of a controlled substance.
Five witnesses presented evidence for Prosecuting Attorney R. Scott Killen. The witnesses included Iron County officers and the pathologist who performed the autopsies of the victims.
Judge Head found that the state had established probable cause that the offenses had been committed and that the defendant was involved in the commission of those felonies.
Barton will be arraigned in circuit court on Wednesday. He has previously been bound over on two other distribution charges. He remains in the county jail.
Barton is charged in connection with the deaths of Alexies Marshall, 57, of Ironton, and Suzanne Bates, 48, of Ironton. The state alleges he distributed methadone to both women and the deaths occurred as a result of that.

it seems that our legal system is getting very desperate in the fight against drugs. I can not be the one to say if this way of dealing with the deaths that take place as a result of drug use, is a logical one, but if it is, then shouldnt anyone who gets convicted of sales, or manufacturing a controlled substance face the same charge of murder. lets face it, anyone knows that if you cut off the head of a snake the body will surely die. but as a common rule we see these people, (drug dealers), get probation, or a slap on the rist. again, i dont claim to have all the answers. But i believe with all my being that if the message was sent that drug dealing with be dealt with in a quick, and unyealding life sentence, the perpotrators may very well think twice before cooking that next batch, or selling that next pill, pot, or substance. If we, or better yet, our appointed watch dogs, (judges, & prosecutors), would take this firm stand once and for all, the dreded snake that is killing our kids,,, would surely die.
